On April 23, 2008 the Fire Prevention and Building Safety Commission published the "Final Rules" for the following codes:

  • The 2008 Indiana Building Code
  • The 2008 Indiana Fire Code
  • The 2008 Indiana Mechanical Code
  • The 2008 Indiana Fuel Gas Code

    At the January 3, 2008 hearing of the Fire Prevention and Building Safety Commission, the following codes were approved as "Final Rules" to be added to the 675 IAC codes:

  • The 2008 Indiana Building Code
  • The 2008 Indiana Fire Code
  • The 2008 Indiana Mechanical Code
  • The 2008 Indiana Fuel Gas Code


  • Each of these adopt by reference the corresponding 2006 International model code.

    These rules have been signed by the Governor, and will become effective on June 16, 2008.

    These amendments are the proposed rules as published in the Indiana Register. The Final Rules adopted by the Commission are not yet available and will contain numerous editorial changes, and a small number of substantive changes

    Recent actions by the Fire Prevention and Building Safety Commission and the Staff t the State Division of Fire and Building Safety have resulted in the following updates to the 675 IAC codes:

  • 1. A set of updated NFPA Standards went into effect on September 22, 2006.
  • 2. An amended version of the General Administrative Rules, affecting fees and Rule 8 among other things, went into effect on September 30, 2006.
  • 3. The Commission has approved a new Indiana Elevator Code as a final rule for publication in the Indiana Register. We are told by Code Services that this code will go into effect on December 15, 2006. Elevator installations for which an Elevator Installation Permit is obtained on or after the effective date will not be required to have an elevator sump pump installed (nor require a variance to not have one installed). We are proceeding on the assumption that any elevator installation for which an Installation Permit is obtained prior to the effective date of the new Elevator Code will still require a variance to not have a sump pump permanently installed in the pit.
  • 4. The new Indiana Energy Conservation Code will not be adopted by the Commission. They elected to retain the current 1992 Energy Code for an undetermined time.
  • 5. The Commission and Division Staff have decided to move ahead with the adoption of the 2006 Editions of the International Building Code, International Fire Code, International Mechanical Code, and International Fuel Gas Code. This is anticipated to be a process that will take approximately 18 months to complete - this would place eventual effective dates in early- to mid-2008.
  • 6. Ed Rensink is a member of the ad-hoc Building Code Committee that will develop amendments for consideration by the Commission as part of the proposed rule for public comment sometime late in 2007. If you have any suggestions for Building Code amendments, please let Ed know as soon as possible.

    Senate Bill 56, signed by the governor, creates the new Department of Homeland Security (DHS). The bill includes many changes to the Department of Fire and Building Services, including the following:

  • The Department of Fire and Building Services is abolished, with the statutory duties and powers transferred to the new Division of Fire and Building Safety (DFBS) within the DHS.
  • The State Fire Marshal serves as the Deputy Executive Director of DFBS and is charged with administering the Division.
  • The Office of the State Building Commissioner (OSBC) is abolished. The statutory duties and powers of the OSBC are transferred to DFBS.
  • The position of Building Law Compliance Officer is created within DFBS, and is responsible for interpreting building and fire safety laws and for issuing Design Releases.
  • Effective April 15, 2005, the terms of all current members on the Fire Prevention and Building Safety Commission (FPBSC) are terminated.
  • The governor is charged with appointing the nine (9) voting members of FPBSC, replacing the current 19 member-commission.

    The state is moving towards adoption of the 2003 International Residential Code, fifth printing. The code committee has completed their work and the Department will be placing a Notice of Intent in the Indiana Register. The International Code Council has agreed to earmark the entire fifth printing for the State of Indiana. To aid in ordering the correct edition, use inventory number 3100 F 03 IN. A total of 1000 copies (loose leaf) will be run for that specific printing.

    Indiana's Department of Fire and Building Services and Department of Commerce, Energy, and Recycling Division are reviewing the 2003 IECC for possible adoption in the fall of 2005. More news will be posted as it becomes available.

    Late last week the Governor signed the proposed 2003 Indiana Building Codes into law. The code packages were filed with the secretary of State and will become effective on the following dates:

  • Indiana Building Code - May 21, 2003

    The 2003 Indiana Building Code will be comprised of the 2000 Edition of the International Building Code, Third Printing and Indiana Amendments. The final version of the Indiana amendments are now available and can be purchased from the ICC Indianapolis Resource Center in Carmel Indiana. The Center can be contacted at 1-800-243-5736. (A preliminary version of the amendments are available in the July 1, 2002 edition of the Indiana Register, (Volume 25, Number 10) as LSA Document #02-115

  • Indiana Fire Code - May 17, 2003 (This code will be administratively enforced as though having a 5/21/03 adoption date)

    The 2003 Indiana Fire Code will be comprised of the 2000 Edition of the International Fire Code, Fourth Printing and Indiana Amendments. The final version of the Indiana amendments are now available and can be purchased from the ICC Indianapolis Resource Center in Carmel Indiana. The Center can be contacted at 1-800-243-5736.   • Indiana Mechanical Code - May 21, 2003

    The 2003 Indiana Mechanical Code will be comprised of the 2000 Edition of the International Mechanical Code, Third Printing and Indiana Amendments. The final version of the Indiana amendments are now available and can be purchased from the ICC Indianapolis Resource Center in Carmel Indiana. The Center can be contacted at 1-800-243-5736.   • Indiana Fuel Gas Code - May 21, 2003

    The Indiana Fuel Gas Code, 2003 Edition will be comprised of the 2000 Edition of the International Fuel Gas Code, Fifth Printing and Indiana Amendments. The final version of the Indiana amendments are now available and can be purchased from the ICC Indianapolis Resource Center in Carmel Indiana. The Center can be contacted at 1-800-243-5736.   • All projects filed with the Department of Fire and Building services on or after the above listed dates will need to meet the requirements of the new codes.
